Communication Consent & SMS Terms

By providing your phone number and opting in to receive messages, you consent to receive text messages from Zealous Growth as described in our Privacy Policy. You can opt out at any time by replying STOP. Your consent is not a condition of service.

Zealous Growth uses SMS to communicate with customers and opted-in leads who have inquired about our digital marketing and web design services. All recipients have opted in by submitting a contact form on our website, booking a call through our scheduling system, or providing their phone number directly during a conversation. Recipients can reply STOP at any time to opt out.

Carrier Liability Disclaimer

Carriers (e.g., T-Mobile, AT&T, Verizon) are not liable for delayed or undelivered messages.

Age Restriction

You must be 18 years of age or older to opt in to receive SMS messages from Zealous Growth. By opting in, you confirm that you are at least 18 years old.

Payment Terms

Payment terms for services will be outlined in your service agreement. Unless otherwise specified:

  • A deposit may be required before work begins
  • Recurring service fees are billed monthly
  • Late payments may result in service suspension
  • All plans require a minimum 3-month initial commitment
  • After the initial 3 months, plans continue on a month-to-month basis and can be cancelled anytime

Limitation of Liability

To the fullest extent permitted by law, Zealous Growth shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services. Our total liability shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

Disclaimer of Warranties

Our website and services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Indemnification

You agree to indemnify and hold harmless Zealous Growth, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from your use of our website or violation of these Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Franklin County, Ohio.

Termination

Monthly plans require a minimum 3-month initial commitment. After the initial term, you may cancel at any time with 30 days written notice. Annual plans are paid upfront for the full term; no prorated refunds are issued for early cancellation.

We reserve the right to terminate or suspend your access to our website at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Changes to These Terms

We may update these Terms from time to time. Continued use of the website after changes constitutes acceptance of the new Terms. We will update the effective date at the top of this page when changes are made.
